Matching a Complex Site with the Ideal Use

CHALLENGE:

Legacy Creek, located on Legacy Drive in Frisco, Texas, one of the fastest-growing markets in the U.S., offered excellent development opportunity but presented several challenges. The site was positioned in a pristine area of the market, but was encumbered by high-voltage transmission lines reducing net developable area. Simultaneously it was adjacent to a politically active neighborhood that had previously opposed high-density projects, causing hesitancy for any developer looking to go vertical. While Senior Living was an approved use under the PD zoning, the ordinance included a blanket 3-story height limit and lacked density and development standards, creating entitlement uncertainty. Given capital market conditions during the time, structuring the right deal would require proactive planning, buyer alignment, and precise execution.

ACTION:

Josh Bryan, founding Partner at Bryan Haggard Land Group, was hired to position the site strategically and navigate the complex entitlement environment. The team:

  • Reviewed the PD ordinance and site history to clarify development limitations and opportunities.
  • Engaged Frisco city planning staff to confirm Senior Living was supported and gain insight on development standards not outlined in the PD.
  • Crafted a focused marketing campaign, targeting developers aligned with the site’s zoning and surrounding neighborhood context.
  • Identified Sovereign Properties, a national Senior Living developer, through a fellow land broker as the ideal buyer for the site.
  • Collaborated with John Dosch of Dosch Marshall, the buyer’s broker, to structure a deal that aligned with both parties’ timing and capital needs.
  • Managed unforeseen development requirements during diligence, and helped address a new open space requirement that affected planned density.

  • Closed on the original contract date, meeting all timing expectations despite zoning and market complexities.
  • Matched the site with a nationally recognized Senior Living developer aligned with both city vision and neighborhood compatibility.
